Terms of Service
Effective Date: June 28, 2018
Modification. AJL reserves the right, at its sole discretion, to modify these Terms at any time and without prior notice. If we modify these Terms, we will either post a notification of the modification on our website or otherwise provide you with notice of the change. The date of the last modification will also be posted at the beginning of these Terms. It is your responsibility to check from time to time for updates. By continuing to access or use the Services, you are indicating that you agree to be bound by any modified Terms.
Eligibility. The Services are intended solely for persons who are at least 13 years old. If you are not 13 or older, you may not use the Services. If you are at least 13 years old but are under 18 years old, you may only use our Services under the supervision of a parent or legal guardian who agrees to be bound by these Terms. If you are a parent or legal guardian agreeing to these Terms for the benefit of such a minor, you are fully responsible for their use of the Services.
Acceptable Use. Conditioned on your adherence to these Terms, AJL grants you permission to use these Services, provided such use remains in compliance with these Terms. You specifically agree that you will adhere to the following restrictions:
You may only use the Services for personal use. You may not transfer your access to others or allow others to access the Services through your own access.
You may only use the Services for lawful activity. It is your responsibility to comply with all applicable local, state, and federal laws and regulations.
You may not interfere with or damage the Services including, without limitation, through the use of viruses, bots, harmful code, denial-of-service attacks, backdoors, packet or IP address spoofing, forged routing, or any similar methods or technology.
Except as authorized through the Services or as permitted through the Services’ implementation of the Robots Exclusion Standard through its “robot.txt” file, you may not scrape, copy, rip, or otherwise systematically capture any content encountered on the Services.
You may not use the Services to upload, transmit, or promote any material that infringes or violates the legal rights (including intellectual property rights) of any other person or party.
Content. The materials displayed or performed or available on or through the Services, including but not limited to text, graphics, data, articles, photos, images, illustrations, and user submissions (all of the foregoing, the “Content”) are protected by copyright and other intellectual property laws. Conditioned upon your compliance with these Terms, AJL grants you a limited, non-exclusive, non-transferable license (1) to access, view, and use the Services, and (2) to view the Content to which you are permitted access. Except as permitted in these Terms you may not use, copy, adapt, modify, prepare derivative works based upon, distribute, license, sell, transfer, publicly display, transmit, broadcast or otherwise exploit the Services.
We may, at our sole discretion, permit you to post, upload, publish, submit or transmit content, including but not limited to personal stories about your experiences with artificial intelligence and facial recognition systems (“User Content”). By submitting any User Content on or through the Services, you grant to AJL a worldwide, irrevocable, perpetual, non-exclusive, transferable, royalty-free license, with the right to sublicense, to use, view, copy, adapt, modify, distribute, license, sell, transfer, publicly display, transmit, stream, broadcast, access, view, and otherwise exploit such User Content, in any format or media, in order to operate, promote, improve, or market the Services.
AJL has the right, but not the obligation, to exercise this license in order to disseminate this User Content. You hereby represent and warrant that:
You are solely responsible for any liability arising from the User Content;
the User Content you submit is truthful and accurate; and
you have all rights, licenses, consents and releases that are necessary to grant to AJL the license in this section.
Third-Party Content. By using the Services, AJL may provide you with access to third-party websites, content, information, and other services, including but not limited to the User Content from other users. You hereby acknowledge that AJL does control such third-party services, and cannot be held responsible for their content, quality, operation, or use. AJL does not give any representation, warranty, or endorsement, express or implied, with respect to the legality, accuracy, quality, or authenticity of content, information, or services provided by such third-party websites and services.
Feedback. We welcome and encourage you to provide feedback, comments and suggestions for improvements to the Services (“Feedback”). You can send such Feedback to us at firstname.lastname@example.org .You agree that AJL has the right, but not the obligation, to use such Feedback without any obligation to provide you credit, royalty payment, or ownership interest in the changes to the Services.
Claims of Copyright Infringement. AJL respects the intellectual property rights of others, and may, in appropriate circumstances and at its sole discretion, delete User Content or suspend access to the Services for those who infringe the copyright interests of others. If you believe that your work is accessible on the Services in a way that infringes copyright, you may notify us by providing the following information (as required by the Digital Millennium Copyright Act, 17 U.S.C. § 512) to our Copyright Agent, identified below:
Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a list of such works;
Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit AJL to locate the material;
Information reasonably sufficient to permit AJL to contact the complaining party, such as an address, telephone number, and if available, an email address at which the complaining party may be contacted;
A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and
A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Warranties. YOU HEREBY ACKNOWLEDGE THAT YOU ARE USING SERVICES AT YOUR OWN RISK. THE SERVICES AND CONTENT ARE PROVIDED "AS IS," AND THE ALGORITHMIC JUSTICE LEAGUE, ITS AFFILIATES, MEMBERS, AND ITS THIRD-PARTY SERVICE PROVIDERS HEREBY DISCLAIM ANY AND ALL WARRANTIES, EXPRESS AND IMPLIED, INCLUDING BUT NOT LIMITED TO ANY WARRANTIES OF ACCURACY, RELIABILITY, MERCHANTABILITY, NON-INFRINGEMENT, FITNESS FOR A PARTICULAR PURPOSE, AND ANY OTHER WARRANTY, CONDITION, GUARANTEE OR REPRESENTATION, WHETHER ORAL, IN WRITING OR IN ELECTRONIC FORM. THE ALGORITHMIC JUSTICE LEAGUE, ITS AFFILIATES, AND ITS THIRD-PARTY SERVICE PROVIDERS DO NOT REPRESENT OR WARRANT THAT ACCESS TO THE SERVICES WILL BE UNINTERRUPTED OR THAT THERE WILL BE NO FAILURES, ERRORS OR OMISSIONS OR LOSS OF TRANSMITTED INFORMATION, OR THAT NO VIRUSES WILL BE TRANSMITTED THROUGH THE SERVICES.
Because some states do not permit disclaimer of implied warranties, you may have additional consumer rights under your local laws.
Limitation on Liability. NEITHER THE ALGORITHMIC JUSTIC LEAGUE NOR ANY OTHER PARTY INVOLVED IN CREATING, PRODUCING, OR DELIVERING THE SERVICES WILL BE LIABLE FOR ANY DIRECT OR INDIRECT DAMAGES RELATED TO PROVISION OF THE SERVICES, INCLUDING BUT NOT LIMITED TO PUNITIVE, CONSEQUENTIAL, EMOTIONAL, OR EXEMPLARY DAMAGES, OR ANY CLAIMS BASED ON LOST PROFITS, DATA, OR GOODWILL. THIS LIMITATION APPLIES WHETHER BASED ON A CLAIM RELATED TO A WARRANTY, CONTRACT, TORT, PRODUCT LIABILITY, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT THE ALGORITHMIC JUSTICE LEAGUE KNEW, SHOULD HAVE KNOWN, OR WAS APPRISED OF SUCH DAMAGES.
IN NO EVENT WILL THE ALGORITHMIC JUSTICE LEAGUE OR ITS MEMBERS OR PARTNERS’ AGGREGATE LIABILITY ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR THE USE OF THE SERVICES EXCEED FIFTY U.S. DOLLARS.
Some states do not allow the exclusion or limitation of liability for certain damages. In such jurisdictions, the liability of Algorithmic Justice League and its affiliates shall be limited to the maximum extent permitted by law.
No Waiver. The failure of AJL to enforce any right or provision of these Terms will not constitute a waiver of future enforcement of that right or provision.
Assignment. You may not assign or transfer these Terms, by operation of law or otherwise, without AJL’s prior written consent. Any attempt by you to assign or transfer these Terms without such consent will be null and of no effect. AJL may assign or transfer these Terms, at its sole discretion, without restriction. Subject to the foregoing, these Terms will bind and inure to the benefit of the parties, their successors and permitted assigns. These Terms do not and are not intended to confer any rights or remedies upon any person other than the parties.
Severability. If for any reason a court of competent jurisdiction finds any provision of these Terms invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the other provisions of these Terms will remain in full force and effect.
Governing Law. These Terms (and any further rules, polices, or guidelines incorporated by reference) shall be governed and construed in accordance with the laws of the Commonwealth of Massachusetts, United States. Any action based on, relating to, or alleging breach of these Terms must be brought in a state or federal court in Middlesex County, Massachusetts. Both parties agree to submit to the exclusive personal jurisdiction and venue of such courts.
Entire Agreement. These Terms constitute the entire agreement between you and AJL regarding your use of the Services, and supersede all prior written or oral agreements. Any amendments to these Terms (other than those contemplated in Section 2 of these Terms) must be made through a written instrument, signed by both parties.
